    P2P Crypto Trading in India: Legal, but Risky in 2026

    P2P crypto trading remains legal in India in 2026, but traders face serious fraud and bank freeze risks. The system allows users to buy or sell crypto directly with other people through platforms offering escrow services. Buyers send INR through UPI or bank transfers, while the platform holds crypto until payment reaches the seller.

    The legal position remains straightforward, as India does not ban individuals from trading Virtual Digital Assets. Crypto is not legal tender, while profits remain subject to India’s crypto tax rules. Platforms covered by anti-money laundering rules must also meet FIU registration and KYC requirements. P2P traders need careful records since direct payments can create difficult compliance issues.

    The biggest concern comes when a buyer uses money linked to cyber fraud or other illegal activity. An innocent crypto seller can receive those funds without knowing their source. Banks or cybercrime agencies may then place a lien or freeze the seller’s account during an investigation.

    India’s Enforcement Directorate highlighted the risk in a 2025 cyber fraud case. The agency said scammers “frequently purchased USDT through peer-to-peer (P2P) transactions on Binance using third-party payments sourced from crime proceeds.”

    Third-party payments remain one of the biggest warning signs for P2P traders. The sender’s name should match the verified buyer listed on the trading order. Traders should also complete KYC, use escrow, save transaction records, and avoid informal deals through Telegram or WhatsApp.

    P2P crypto trading also follows India’s VDA tax framework, including a 30% tax on eligible gains and applicable TDS requirements. Accurate records can help traders report transactions correctly during tax filing.

    For beginners, FIU-registered exchanges may offer a safer route for buying or selling crypto. P2P trading can still work for experienced traders, but careful verification remains essential.
