Gujarat HC Grants Conditional Bail to Ex-IPS Jagdish Patel, Notes Circumstantial Evidence and No Direct Ransom Link in Rs. 32 Cr Case
The Gujarat High Court has suspended the life sentence of former IPS officer and ex-SP of Amreli, Jagdish Patel. The court granted him conditional bail while his appeal is being heard. The judges said the evidence against him is mostly circumstantial.
The case goes back to February 2018, when Surat businessman Shailesh Bhatt was kidnapped to force him to give cryptocurrency. The kidnappers demanded 176 Bitcoins, worth around Rs. 32 crore at that time.
Patel’s Alleged Role and Previous Conviction
The crime is linked to the collapse of the BitConnect Ponzi scheme. Investigations said Patel and former BJP MLA Nalin Kotadiya planned the kidnapping, and several police officers carried it out.
A special ACB court in Ahmedabad had sentenced 15 people, including Patel and Kotadiya, to life imprisonment for kidnapping and criminal conspiracy. They were also fined, and Patel’s gold jewelry worth Rs. 2.4 crore was seized. The court had mostly used phone records and circumstantial evidence, as many witnesses turned hostile.
High Court Observations and Bail Conditions
The Gujarat High Court, led by Justices Ilesh Vora and R T Vachhani, said Patel was not at the crime scene and had no direct contact with the co-accused. They also found no proof that he got any money from the ransom.
The court noted delays in the appeal and gave him conditional bail, with limits on his travel. Earlier, Kotadiya and nine police officers were also granted bail.
Challenges in Crypto Crime Investigations
This case shows the challenges of dealing with crypto crime in India. Digital assets are hard to trace, and investigations can be complicated. The case also shows the risks when police officers or politicians are involved. Stronger crypto laws may be needed to prevent such crimes.
The victim, Shailesh Bhatt, also faces legal trouble. He is accused of kidnapping BitConnect employees and extorting cryptocurrency. Investigators found over Rs. 155 crore linked to his activities.
